(VOR News) – The United States Senate declined to pass legislation that would have penalized the International Criminal Court (ICC) for issuing arrest warrants for former Defense Minister Yoav Gallant and Israeli Prime Minister Benjamin Netanyahu.

On Tuesday, the measure garnered 54 ballots in favor and 45 votes against. Consequently, the measure was unable to advance to the final vote due to the absence of the necessary sixty votes.

Although some Democrats criticized the court for unjustly singling out Israel, others expressed their disapproval of the measure. In May of this year, the International Criminal Court (ICC) issued warrants for Netanyahu and Gallant in relation to allegations of war crimes committed in Gaza, particularly via the instrument of famine.

Mohammed Deif, the military chief of Hamas, was sought by the court for his involvement in the assaults on southern Israel on October 7, 2023.

Concerns regarding the authority of the law.

The proposed law in the United States has been met with severe criticism from European politicians, former officials of the International Criminal Court, and international legal experts.

Human rights experts from the United Nations have cautioned that such an action would compromise global efforts to impose responsibility and establish a hazardous precedent.

Chuck Schumer, the Senate’s majority leader, has expressed his willingness to contest the allegations made against Israel by the International Criminal Court (ICC). He voted against the measure, despite the fact that he believed it was “poorly drafted and greatly problematic.”

He strongly recommended that Republican senators examine the language of the measure in order to mitigate the likelihood of adverse consequences for American companies and organizations that interact with the court.

John Thune, the Republican Whip of the Senate Minority, voted in favor of the measure, stating that the US government should pay heed to actions taken against Israel of this nature. He stated that the International Criminal Court may shift its attention to ICC Americans during the period in which it is focusing on Israelis.

Senator John Fetterman was the sole Democrat to endorse the legislation; the American Israel Public Affairs Committee (AIPAC), a prominent pro-Israel advocacy organization, expressed its appreciation for his support.

Overview of US Sanctions Against the International Criminal Court (ICC).

The recommendation to penalize the International Criminal Court is redolent of a strategy implemented by former US President Donald Trump.

Trump approved officials of the International Criminal Court (ICC) in 2020 due to his apprehension that the court was evaluating US military operations abroad.

Despite the fact that Trump reversed the Biden administration’s decision to remove the penalties shortly after assuming office last week, the sanctions’ reinstatement is now essentially symbolic.

Israel and the United States have not ratified the Rome Statute, which established the International Criminal Court. Nevertheless, the European Court of Human Rights asserts jurisdiction over any crimes committed in Gaza, as Palestine has been a member since 2015.

Allegations of war atrocities are numerous.

The International Criminal Court’s attorneys have accused Netanyahu and Gallant of war crimes and crimes against humanity, particularly for the deliberate delay of supplies to Gaza. They also referenced Israeli attacks on individuals, as well as other actions that are classified as criminal deeds and acts of persecution.

The majority of the Gaza area’s population has been displaced as a result of Israel’s ongoing military operations, which have resulted in approximately 47,000 Palestinian fatalities. Ever since January 19, its status has been preserved by a limited cease-fire.

Ismail Haniyeh and Yahya Sinwar, leaders of Hamas, were slain by Israeli aircraft prior to any action being taken. The International Criminal Court also requested arrest orders for each of them.

At the outset of this month, United Nations experts pleaded with the United States Senate to reject the new rule, asserting that it would establish a “culture of impunity” and undermine the international legal system.

The current and former presidents of the International Criminal Court (ICC) issued a warning in an article published on Monday, stating that penalizing the court could substantially impede over twenty investigations that are already in progress worldwide.

The essay contended that the notion that the rule of law safeguards the impoverished from the wealthy is undermined by opposition to the International Criminal Court (ICC).
